Oil, Gas and Natural Resource
Pennsylvania has a long history of oil and natural gas exploration. In recent years the Marcellus Shale development in this region has resulted in unprecedented activity in what is emerging as a multi-billion dollar industry. Pettit & Spontak, PLLC, has represented private landowners, as well as commercial landowners and not-for-profit organizations, relating to issues that have arisen in connection with these gas operations. We have negotiated gas leases for landowners with parcels ranging from over 250 acres to less than 1 acre.
This practice area has lead to Pettit & Spontak, PLLC, representing landowners throughout southwestern Pennsylvania, including Allegheny, Armstrong, Beaver, Butler, Greene, Indiana, Lawrence, Westmoreland and Washington Counties. Our oil and gas practice includes both negotiating natural gas development rights on behalf of landowners, and providing legal counsel to property owners who are involved in disputes regarding gas leases. While obtaining favorable bonus and royalty terms is an important component of the work that we do for our clients, we also work diligently to address issues directly affecting our clients’ land. We have successfully handled complex issues relating to water use and testing, wellsite location, eligibility problems relating to Pennsylvania’s Clean and Green Program, and have resolved issues relating to existing wells on property.
The attorneys at Pettit & Spontak, PLLC have the necessary trial and litigation experience to provide landowners with comprehensive representation in connection with disputes arising out of the gas lease including payment of royalties issues, title disputes, lease termination claims, failure to reasonably develop claims, surface use issues and environmental compliance issues. Additionally, we have represented landowners in filing formal objections to gas operator’s drilling permits filed with the Pennsylvania Department of Environmental Protection.
